Who Gets Paid Out of a Queens Injury

What a Queens Executor Can and Cannot Reach When Beneficiary Forms Conflict With the Will

An executor appointed by the Queens County Surrogate’s Court has authority over a narrower category of property than the will itself suggests. Letters testamentary grant power over the probate estate, meaning assets held in the decedent’s name alone. Anything carrying a beneficiary designation sits outside that grant entirely, and no amount of authority from the Court changes where it goes.

The Institution Answers to the Form

Under the Estates, Powers and Trusts Law (EPTL) § 13-3.2, retirement, pension, and annuity benefits pay to whoever is named on the account paperwork. A bank or insurer reviewing a claim looks at its own records, not at the will. When an executor in Elmhurst or Whitestone presents letters testamentary for an individual retirement account that names a beneficiary, the institution declines, and it is correct to decline.

Timing Works Against the Estate

A beneficiary claim requires little more than a death certificate and a claim form, and the money often moves within a few weeks. Probate in Queens County runs considerably longer. By the time the will is admitted and letters issue, the accounts that were supposed to fund the shares written into the will have frequently already been paid out. That sequence is what I spend the most time explaining to families in Astoria and Richmond Hill.

What Remains Available

Not every conflict is beyond reach. A surviving spouse may assert a right of election under EPTL § 5-1.1-A, which counts most designations as testamentary substitutes in the calculation. A designation changed shortly before death can be challenged on grounds of capacity or undue influence. A joint account added for bill-paying convenience can be contested as never having been intended to pass to the survivor. And where a named beneficiary died first with no contingent listed, the asset returns to the estate and does fall under the executor’s authority.

Why This Belongs in the Planning Stage

Every problem above is inexpensive to prevent and costly to litigate. That is why I advise clients at my Union Turnpike office to treat beneficiary forms as part of the estate plan rather than as banking paperwork, and to tell the person named as executor which accounts exist and who is on them. An executor who learns the structure of an estate for the first time at a bank counter in Kew Gardens is already behind. A short review with a beneficiary designation attorney in Queens usually settles the question in one sitting.

If your loved one left behind accounts that passed by beneficiary designation which need to be reviewed, contact us today for a free phone consultation.
