What Is an Affidavit of Heirship?

It is a sworn statement, usually signed by a relative or someone who knew the family well, listing who the legal heirs are under New York’s intestacy laws. Because so many Queens families own modest bank accounts, co-op shares, or a single vehicle, this affidavit can sometimes avoid the need to open a full estate proceeding in the Surrogate’s Court of Queens County.

When Does It Actually Work?

It works best for small, uncontested estates. A bank in Forest Hills or a credit union in Astoria may accept an affidavit to release a modest account balance. The DMV may accept one to transfer a car title. But once real estate, a larger account, or a disagreement among relatives enters the picture, the affidavit usually is not enough on its own.
