How Queens Families Can Locate and Claim a Decedent’s Unclaimed Funds in New York

If your family recently lost someone here in Queens, it’s worth checking whether they left behind money you don’t know about. Forgotten bank accounts, uncashed insurance checks, and old utility deposits often end up in the custody of New York State, and much of what the state holds is owed to families who have no idea it exists.

What Counts as Unclaimed Funds

Unclaimed funds cover dormant bank accounts, uncashed payroll or dividend checks, matured life insurance, utility deposits, and contents of abandoned safe deposit boxes. Under New York’s Abandoned Property Law, banks, insurers, and other institutions must turn these assets over to the state after a period of inactivity, usually three to five years. The Comptroller’s Office acts only as custodian; it never owns the money.

Searching the Comptroller’s Database

I tell every Woodside and Elmhurst client to search the New York State Comptroller’s Office of Unclaimed Funds database under the decedent’s full name, including maiden names and spelling variations. The search is free and takes minutes. I have seen clients from Ridgewood turn up several thousand dollars sitting under a parent’s or grandparent’s name.

Filing the Claim

Once you find a match, the Office of Unclaimed Funds will require proof you are entitled to the money — a death certificate, evidence of your relationship to the decedent, and, for larger accounts, documentation showing legal authority over the estate.

Why Letters Testamentary or Letters of Administration Matter

This is where most families stall. If the account exceeds a modest threshold, the Comptroller’s Office will not hand money to a spouse or child simply for being next of kin. You need Letters Testamentary, if there is a will, or Letters of Administration, if there is not, issued by the Queens County Surrogate’s Court in Jamaica. Our office sits close enough to that courthouse that we file there regularly, and I have seen how quickly a petition can stall over a missing signature or an heir who cannot be located.

That is why I advise my Queens clients to open the estate proceeding the moment they begin searching for unclaimed funds, rather than waiting to find a specific account first. Having Letters in hand means you can claim money the day it turns up, and use that same authority for every other estate asset. I have guided families across Maspeth, Middle Village, and the rest of Queens through this process, and knowing the Surrogate’s Court’s local practices keeps petitions moving instead of stalling in paperwork.
